Acceptance of Terms

By creating a Valix account, submitting a rental application through Valix, or using the Valix tenant, owner, investor or contractor portals, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, you may not use the service.

Eligibility

You must be at least 18 years old, and of the age of majority where you live, to create a Valix account, submit a rental application, or use any Valix portal. Valix is not directed to children. A property manager may record the name of a minor household member as an occupant on a lease; that child does not use Valix.

Subscription and Billing

Valix is a monthly subscription that continues until you cancel. Fees are charged per active unit at your plan's rate, plus any add-ons you choose, and are billed monthly on the 1st of each month for your active unit count. Most plans have a monthly minimum, shown on the pricing page and on your quote; when your unit fees for a month come to less than your plan's minimum, the minimum is charged.

If you have signed an order form or Enterprise agreement with a fixed term, that agreement's term, billing and cancellation provisions apply in place of this section where they differ.

We may change our prices with at least 30 days' notice by email to your account's billing contact. A new price applies from the first billing period that starts after the notice period ends, and you can cancel before then.

Your subscription renews each month until you cancel. You can cancel online at any time in Settings → Subscription; there is no notice period. Cancellation takes effect at the end of the current billing period, and you keep access until then. Units under management up to that date are billed on your next invoice. Fees already billed are not refunded except as required by law.

Your Responsibilities

• You are responsible for the accuracy of the data you enter
• You must keep your login credentials confidential
• You may not use Valix for unlawful purposes
• You are responsible for complying with local landlord-tenant laws

Data Ownership

You retain ownership of all data you upload to Valix. We process it on your behalf to provide the service. You can export all your data at any time as CSV or PDF.

Listing content licence. When you publish a listing, you grant Valix a non-exclusive, royalty-free licence to host, reproduce, resize, watermark, display and transmit the listing's photos, floor plans, videos, descriptions and other content to the destinations you choose, such as your public listing page and the listing sites you turn on, for as long as the listing is published.

Your rights in what you upload. You confirm that you own, or have permission from the owner to use and to let us use in this way, everything you upload to or link from Valix, including photos taken by photographers and images taken from other sources. You agree to indemnify Valix against claims that content you uploaded or linked infringes someone else's rights.

Service Availability

We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows are announced in advance.

Limitation of Liability

Valix is provided "as is". Our total liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Copyright and DMCA

We respect the rights of copyright owners. If you believe material hosted on Valix, such as a listing photo, infringes your copyright, send a written notice to:

Under the Digital Millennium Copyright Act (17 U.S.C. § 512), a valid notice includes:

• your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
• identification of the copyrighted work you say is infringed;
• identification of the material you say is infringing, with enough detail for us to find it, such as the page address (URL);
• your name, postal address, telephone number and email address;
• a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
• a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

When we receive a valid notice, we remove or disable access to the material and tell the customer who posted it. Knowingly misrepresenting that material is infringing can make you liable for damages.

Counter-notice. If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address. It must include your physical or electronic signature; identification of the material and where it appeared before it was removed; a statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification; and your name, address and telephone number, with a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district in which Valix may be found) and will accept service of process from the person who sent the original notice. We forward the counter-notice to that person and restore the material 10 to 14 business days later unless they tell us they have filed a court action to stop the infringement.

Repeat infringers. We terminate the accounts of repeat infringers.
